1. About These Terms

These Terms of Service govern access to and use of the website, services, products, memberships, packages, digital tools, and related offerings provided by DouFit Club FZ-LLC trading as DouFit (“DouFit”, “we”, “us”, or “our”).

تحكم شروط الاستخدام هذه الوصول إلى واستخدام الموقع الإلكتروني والخدمات والمنتجات والعضويات والباقات والأدوات الرقمية والعروض ذات الصلة المقدمة من دوفِت كلَب ش.ذ.م.م تحت الاسم التجاري DouFit ويشار إليها في هذه الشروط بـ "DouFit" أو "نحن" أو "لنا".

By accessing our website, purchasing from us, booking with us, or using any DouFit service, you agree to these Terms together with any applicable refund policy, privacy policy, waiver, package terms, membership terms, booking rules, or other terms made available to you.

من خلال دخولك إلى موقعنا الإلكتروني أو شرائك منا أو حجزك معنا أو استخدامك لأي خدمة من خدمات DouFit، فإنك توافق على هذه الشروط إلى جانب أي سياسة استرداد أو سياسة خصوصية أو إقرار مسؤولية أو شروط باقة أو شروط عضوية أو قواعد حجز أو أي شروط أخرى يتم إتاحتها لك.

If you do not agree to these Terms, you must not use our website or services.

إذا كنت لا توافق على هذه الشروط، فيجب عليك عدم استخدام موقعنا الإلكتروني أو خدماتنا.

2. Our Business

DouFit provides wellness, fitness, and related services, which may include personal training, recovery sessions, assessments, onboarding, digital coaching, nutrition guidance, app-based support, consultations, and selected products such as supplements or merchandise.

تقدم DouFit خدمات العافية واللياقة البدنية والخدمات ذات الصلة، والتي قد تشمل التدريب الشخصي وجلسات الاستشفاء والتقييمات وخدمات التهيئة والتدريب الرقمي والإرشاد الغذائي والدعم المعتمد على التطبيق والاستشارات وبعض المنتجات مثل المكملات الغذائية أو المنتجات التجارية.

Our services may be delivered in person, remotely, digitally, at partner facilities, at a client’s location, or through third-party tools and platforms.

قد يتم تقديم خدماتنا حضورياً أو عن بُعد أو رقمياً أو في مرافق شريكة أو في موقع العميل أو من خلال أدوات ومنصات تابعة لأطراف ثالثة.

3. Eligibility

٣. الأهلية

You must provide accurate, current, and complete information when dealing with DouFit and may only purchase or use our services if you have legal capacity to do so.

يجب عليك تقديم معلومات صحيحة وحديثة وكاملة عند التعامل مع DouFit، ولا يجوز لك شراء خدماتنا أو استخدامها إلا إذا كانت لديك الأهلية القانونية للقيام بذلك.

If a service is purchased for or used by a minor, the minor’s parent or legal guardian must approve and accept responsibility for that minor’s participation, compliance, and safety.

إذا تم شراء خدمة أو استخدامها لصالح قاصر، فيجب أن يوافق ولي أمر القاصر أو الوصي القانوني عليه وأن يتحمل المسؤولية عن مشاركته والتزامه وسلامته.

4. Health, Fitness, and Medical Responsibility

DouFit’s services involve physical activity and may not be suitable for everyone. You are responsible for ensuring that you are medically and physically fit to participate.

تنطوي خدمات DouFit على نشاط بدني وقد لا تكون مناسبة للجميع. وتقع على عاتقك مسؤولية التأكد من أنك لائق طبياً وبدنياً للمشاركة.

You must disclose any medical condition, injury, pregnancy, limitation, medication, allergy, or other relevant health information that may affect your participation, safety, or suitability for a service.

يجب عليك الإفصاح عن أي حالة طبية أو إصابة أو حمل أو قيد أو دواء أو حساسية أو أي معلومات صحية ذات صلة قد تؤثر على مشاركتك أو سلامتك أو ملاءمتك للخدمة.

DouFit does not provide medical diagnosis, treatment, or emergency care, and nothing on our website or in our services constitutes medical advice.

لا تقدم DouFit تشخيصاً طبياً أو علاجاً أو رعاية طارئة، ولا يُعد أي شيء وارد في موقعنا الإلكتروني أو خدماتنا نصيحة طبية.

You should consult a qualified physician or other licensed healthcare professional before starting or changing any exercise, nutrition, supplement, recovery, or wellness program.

ينبغي لك استشارة طبيب مؤهل أو مختص رعاية صحية مرخص قبل البدء في أي برنامج للتمارين أو التغذية أو المكملات أو الاستشفاء أو العافية أو تعديله.

DouFit may refuse, suspend, modify, or discontinue any service if we reasonably believe participation may be unsafe or inappropriate.

يجوز لـ DouFit رفض أي خدمة أو تعليقها أو تعديلها أو إيقافها إذا اعتقدنا بشكل معقول أن المشاركة قد تكون غير آمنة أو غير مناسبة.

5. No Guaranteed Results

٥. عدم ضمان النتائج

Fitness, body composition, health, performance, and wellness outcomes vary from person to person. DouFit does not guarantee any specific result, including weight loss, muscle gain, performance improvement, recovery outcomes, or medical benefit.

تختلف نتائج اللياقة البدنية وتركيب الجسم والصحة والأداء والعافية من شخص لآخر. ولا تضمن DouFit أي نتيجة محددة، بما في ذلك فقدان الوزن أو زيادة العضلات أو تحسين الأداء أو نتائج الاستشفاء أو أي فائدة طبية.

Results depend on many factors outside our control, including adherence, nutrition, sleep, effort, baseline condition, stress, health status, and consistency.

وتعتمد النتائج على عوامل عديدة خارجة عن سيطرتنا، بما في ذلك الالتزام والتغذية والنوم والجهد والحالة الأساسية والتوتر والحالة الصحية والاستمرارية.

6. Bookings, Scheduling, and Attendance

٦. الحجوزات والجدولة والحضور

All bookings are subject to availability, trainer availability, operating capacity, location constraints, and other practical factors.

تخضع جميع الحجوزات للتوافر وتوافر المدربين والطاقة التشغيلية وقيود الموقع والعوامل العملية الأخرى.

Clients must attend sessions on time and follow applicable instructions, safety directions, facility rules, and etiquette.

يجب على العملاء حضور الجلسات في الوقت المحدد والالتزام بالتعليمات والتوجيهات المتعلقة بالسلامة وقواعد المرافق وآداب التعامل المعمول بها.

If you are late, the session may still end at the scheduled time.

إذا تأخرت، فقد تنتهي الجلسة في الوقت المحدد لها أصلاً.

DouFit may reschedule, reassign, or replace sessions where necessary for operational, safety, staffing, venue, or other reasonable reasons.

يجوز لـ DouFit إعادة جدولة الجلسات أو إعادة تخصيصها أو استبدالها عند الضرورة لأسباب تشغيلية أو متعلقة بالسلامة أو التوظيف أو مكان تقديم الخدمة أو أي أسباب معقولة أخرى.

7. Payments

٧. المدفوعات

All prices, fees, and charges communicated by DouFit are payable in the manner and timing specified at purchase, booking, invoice, subscription plan, or checkout.

تُستحق جميع الأسعار والرسوم والمبالغ التي تبلغها DouFit بالطريقة وفي المواعيد المحددة عند الشراء أو الحجز أو الفاتورة أو خطة الاشتراك أو السداد.

DouFit may require advance payment in full or in part for packages, memberships, products, or services.

يجوز لـ DouFit طلب السداد مقدماً كلياً أو جزئياً بالنسبة للباقات أو العضويات أو المنتجات أو الخدمات.

Where recurring billing applies, you authorize DouFit and its payment service providers to charge the applicable fees in accordance with the billing plan selected by you.

عند تطبيق الفوترة المتكررة، فإنك تفوض DouFit ومزودي خدمات الدفع التابعين لها في تحصيل الرسوم المطبقة وفقاً لخطة الفوترة التي اخترتها.

You are responsible for providing valid, current, and complete payment information.

أنت مسؤول عن تقديم معلومات دفع صحيحة وسارية وكاملة.

8. Refunds, Cancellations, and Freezes

٨. الاسترداد والإلغاء والتجميد

Refunds, cancellations, rescheduling, no-shows, expiry, and freezes are governed by DouFit’s Refund / Cancellation Policy, which forms part of these Terms.

تخضع عمليات الاسترداد والإلغاء وإعادة الجدولة وحالات عدم الحضور وانتهاء الصلاحية والتجميد لسياسة الاسترداد / الإلغاء الخاصة بـ DouFit، والتي تُعد جزءاً من هذه الشروط.

If there is any conflict between a special written agreement and the standard website policy, the written agreement signed or expressly accepted by DouFit shall prevail to the extent of that conflict.

وفي حال وجود تعارض بين اتفاق خاص مكتوب والسياسة القياسية المنشورة على الموقع الإلكتروني، فتسود أحكام الاتفاق المكتوب الموقع أو المقبول صراحة من DouFit في حدود هذا التعارض.

9. Memberships and Packages

٩. العضويات والباقات

Memberships and packages may be subject to validity periods, minimum commitment periods, consumption rules, booking limits, freeze limits, personal-use restrictions, and other conditions communicated at purchase or in your plan details.

قد تخضع العضويات والباقات لفترات صلاحية أو فترات حد أدنى للالتزام أو قواعد استهلاك أو حدود حجز أو حدود تجميد أو قيود استخدام شخصي أو شروط أخرى يتم إبلاغك بها عند الشراء أو ضمن تفاصيل خطتك.

Unless expressly stated otherwise, memberships and packages are personal to the client and may not be assigned, resold, shared, or transferred.

ما لم يُنص صراحة على خلاف ذلك، فإن العضويات والباقات شخصية للعميل ولا يجوز التنازل عنها أو إعادة بيعها أو مشاركتها أو نقلها.

DouFit may suspend or terminate access where misuse, fraud, abuse, manipulation, repeated no-shows, unsafe conduct, harassment, or policy breaches occur.

يجوز لـ DouFit تعليق أو إنهاء الوصول عند حدوث إساءة استخدام أو احتيال أو استغلال أو تلاعب أو تكرار حالات عدم الحضور أو سلوك غير آمن أو مضايقة أو مخالفة للسياسات.

10. Digital Services and App Use

١٠. الخدمات الرقمية واستخدام التطبيق

Where DouFit provides digital coaching, app access, plans, progress tracking, check-ins, messaging, or similar remote services, including through third-party platforms such as Trainerize, you are granted a limited, non-transferable, revocable right to use those services for your personal, lawful use only.

عندما تقدم DouFit تدريباً رقمياً أو وصولاً إلى التطبيق أو خططاً أو تتبعاً للتقدم أو متابعات أو مراسلات أو خدمات مشابهة عن بُعد، بما في ذلك من خلال منصات طرف ثالث مثل Trainerize، فإنك تُمنح حقاً محدوداً وقابلاً للإلغاء وغير قابل للنقل لاستخدام تلك الخدمات لاستخدامك الشخصي المشروع فقط.

You must not copy, distribute, publish, sell, scrape, reverse engineer, misuse, or exploit any DouFit digital content, plans, systems, software integrations, or materials except as expressly permitted by us.

ويحظر عليك نسخ أو توزيع أو نشر أو بيع أو استخراج أو الهندسة العكسية أو إساءة استخدام أو استغلال أي محتوى رقمي أو خطط أو أنظمة أو تكاملات برمجية أو مواد تخص DouFit إلا بالقدر الذي نسمح به صراحةً.

DouFit may suspend or disable access to any digital service at any time for maintenance, security, legal, operational, compliance, or platform-related reasons.

يجوز لـ DouFit تعليق أو تعطيل الوصول إلى أي خدمة رقمية في أي وقت لأسباب تتعلق بالصيانة أو الأمن أو القانون أو التشغيل أو الامتثال أو المنصة المستخدمة.

11. Communications

١١. الاتصالات

By engaging with DouFit, you agree that we may contact you using reasonable business channels such as email, phone, SMS, WhatsApp, website forms, app messaging, or other agreed communication methods for bookings, reminders, coaching, service updates, support, billing, and administrative matters.

من خلال تعاملك مع DouFit، فإنك توافق على أن نقوم بالتواصل معك عبر قنوات عمل معقولة مثل البريد الإلكتروني أو الهاتف أو الرسائل النصية أو واتساب أو نماذج الموقع الإلكتروني أو رسائل التطبيقات أو غيرها من وسائل الاتصال المتفق عليها فيما يتعلق بالحجوزات والتذكيرات والتدريب وتحديثات الخدمة والدعم والفوترة والمسائل الإدارية.

Marketing communications remain subject to your preferences and applicable law.

وتظل الاتصالات التسويقية خاضعة لتفضيلاتك والقانون المعمول به.

12. Products and Supplements

١٢. المنتجات والمكملات الغذائية

Products, including supplements and merchandise, must be used only in accordance with their instructions and applicable safety guidance.

يجب استخدام المنتجات، بما في ذلك المكملات الغذائية والمنتجات التجارية، وفقاً لتعليماتها وإرشادات السلامة المعمول بها فقط.

DouFit does not guarantee that any supplement or product is suitable for your individual health condition, allergies, medications, or goals.

ولا تضمن DouFit أن أي مكمل غذائي أو منتج مناسب لحالتك الصحية الفردية أو حساسياتك أو أدويتك أو أهدافك.

You are responsible for reading labels, checking ingredients, and obtaining medical advice where appropriate.

وأنت مسؤول عن قراءة الملصقات والتحقق من المكونات والحصول على مشورة طبية عند الاقتضاء.

13. Client Conduct

١٣. سلوك العميل

You must behave respectfully and lawfully toward DouFit staff, trainers, partners, venues, and other clients.

يجب عليك التصرف باحترام وبشكل قانوني تجاه موظفي DouFit ومدربيها وشركائها والأماكن التي تقدم فيها الخدمات والعملاء الآخرين.

Abusive, threatening, discriminatory, harassing, dishonest, unsafe, or disruptive conduct may result in immediate suspension or termination of services without refund, subject to applicable law.

وقد يؤدي السلوك المسيء أو المهدد أو التمييزي أو المتحرش أو غير الأمين أو غير الآمن أو المسبب للاضطراب إلى تعليق أو إنهاء الخدمات فوراً دون استرداد، وذلك وفقاً للقانون المعمول به.

14. Third-Party Providers and Facilities

١٤. مقدمو الخدمات والجهات والمرافق التابعة لأطراف ثالثة

DouFit may use or recommend third-party platforms, facilities, payment providers, analytics tools, communication tools, marketing tools, customer-management tools, and delivery or hosting partners, including without limitation Wix, Stripe, Trainerize, Google Analytics, Meta Pixel, Mailchimp, and Airtable.

قد تستخدم DouFit أو توصي بمنصات أو مرافق أو مزودي دفع أو أدوات تحليلات أو أدوات تواصل أو أدوات تسويق أو أدوات لإدارة العملاء أو شركاء استضافة أو توصيل تابعين لأطراف ثالثة، بما في ذلك على سبيل المثال لا الحصر Wix وStripe وTrainerize وGoogle Analytics وMeta Pixel وMailchimp وAirtable.

To the maximum extent permitted by law, DouFit is not responsible for the independent acts, omissions, outages, policies, technical failures, security incidents, or service interruptions of third parties that we do not control.

وإلى أقصى حد يسمح به القانون، لا تتحمل DouFit مسؤولية الأفعال أو الامتناعات أو الانقطاعات أو السياسات أو الإخفاقات التقنية أو الحوادث الأمنية أو توقف الخدمات المستقلة للأطراف الثالثة التي لا نسيطر عليها.

15. Intellectual Property

١٥. الملكية الفكرية

All content, branding, logos, text, images, plans, forms, programs, systems, methods, videos, documents, templates, and materials made available by DouFit are owned by or licensed to DouFit unless otherwise stated.

جميع المحتويات والعلامات التجارية والشعارات والنصوص والصور والخطط والنماذج والبرامج والأنظمة والأساليب ومقاطع الفيديو والمستندات والقوالب والمواد التي تتيحها DouFit مملوكة لـ DouFit أو مرخصة لها ما لم يُذكر خلاف ذلك.

Nothing in these Terms transfers any intellectual property rights to you.

ولا تنقل لك هذه الشروط أي حقوق ملكية فكرية.

16. Website Use

١٦. استخدام الموقع الإلكتروني

You must not use our website in any unlawful, fraudulent, harmful, abusive, or technically disruptive way.

يحظر عليك استخدام موقعنا الإلكتروني بأي طريقة غير قانونية أو احتيالية أو ضارة أو مسيئة أو معطلة تقنياً.

You must not attempt unauthorized access, introduce malicious code, interfere with security, impersonate others, scrape data unlawfully, or misuse forms, bookings, accounts, or communication channels.

ويحظر عليك محاولة الوصول غير المصرح به أو إدخال شفرات ضارة أو العبث بالأمن أو انتحال شخصية الغير أو جمع البيانات بصورة غير مشروعة أو إساءة استخدام النماذج أو الحجوزات أو الحسابات أو قنوات الاتصال.

17. Disclaimers

١٧. إخلاء المسؤولية

To the maximum extent permitted by law, DouFit provides its website, content, and services on an “as is” and “as available” basis.

إلى أقصى حد يسمح به القانون، تقدم DouFit موقعها الإلكتروني ومحتواها وخدماتها على أساس "كما هي" و"حسب التوافر".

We do not guarantee uninterrupted availability, error-free operation, compatibility with every device or platform, or that any content will always be complete, current, or suitable for every purpose.

ولا نضمن التوافر المستمر أو التشغيل الخالي من الأخطاء أو التوافق مع كل جهاز أو منصة أو أن يكون أي محتوى كاملاً أو محدثاً أو مناسباً دائماً لكل غرض.

18. Limitation of Liability

١٨. تحديد المسؤولية

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.

لا يوجد في هذه الشروط ما يستبعد أو يحد من أي مسؤولية لا يجوز قانوناً استبعادها أو الحد منها بموجب القانون المعمول به.

Subject to the above, to the maximum extent permitted by law, DouFit shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary loss or damage, including loss of profits, loss of opportunity, loss of data, reputational harm, or business interruption.

ومع مراعاة ما سبق، وإلى أقصى حد يسمح به القانون، لا تتحمل DouFit المسؤولية عن أي خسارة أو ضرر غير مباشر أو عرضي أو خاص أو تبعي أو عقابي أو نموذجي، بما في ذلك خسارة الأرباح أو الفرص أو البيانات أو السمعة أو انقطاع الأعمال.

To the maximum extent permitted by law, DouFit’s total aggregate liability arising out of or relating to any claim shall not exceed the amount actually paid by the client to DouFit for the specific service or product directly giving rise to that claim during the three months preceding the event giving rise to the claim.

وإلى أقصى حد يسمح به القانون، لا يتجاوز إجمالي مسؤولية DouFit الناشئة عن أي مطالبة أو المرتبطة بها المبلغ الذي دفعه العميل فعلياً إلى DouFit مقابل الخدمة أو المنتج المحدد الذي نشأت عنه تلك المطالبة مباشرة خلال الأشهر الثلاثة السابقة للواقعة التي أدت إلى المطالبة.

19. Indemnity

١٩. التعويض

You agree to indemnify and hold harmless DouFit, its owners, officers, employees, trainers, contractors, and affiliates from and against claims, losses, liabilities, costs, and expenses arising from your misuse of the website or services, your breach of these Terms, your unlawful conduct, or your negligence, to the extent permitted by law.

توافق على تعويض DouFit وملاكها ومسؤوليها وموظفيها ومدربيها ومتعاقديها والجهات التابعة لها وإبراء ذمتهم من أي مطالبات أو خسائر أو مسؤوليات أو تكاليف أو مصروفات تنشأ عن إساءة استخدامك للموقع الإلكتروني أو الخدمات أو إخلالك بهذه الشروط أو سلوكك غير القانوني أو إهمالك، وذلك إلى الحد الذي يسمح به القانون.

20. Suspension and Termination

٢٠. التعليق والإنهاء

DouFit may suspend, restrict, or terminate access to the website or services, with or without notice, where reasonably necessary for safety, legal, operational, commercial, payment, compliance, or misconduct reasons.

يجوز لـ DouFit تعليق أو تقييد أو إنهاء الوصول إلى الموقع الإلكتروني أو الخدمات، مع أو بدون إشعار، متى كان ذلك ضرورياً بشكل معقول لأسباب تتعلق بالسلامة أو القانون أو التشغيل أو الجوانب التجارية أو الدفع أو الامتثال أو سوء السلوك.

Termination does not affect rights and obligations that accrued before termination.

ولا يؤثر الإنهاء على الحقوق والالتزامات التي نشأت قبل الإنهاء.

21. Privacy

Your use of the website and services is also governed by our Privacy Policy.

22. Changes to Services or Terms

٢٢. تعديل الخدمات أو الشروط

DouFit may update, suspend, replace, or discontinue any service, feature, price, program, trainer allocation, partner arrangement, digital tool, or website content at any time.

يجوز لـ DouFit تحديث أو تعليق أو استبدال أو إيقاف أي خدمة أو ميزة أو سعر أو برنامج أو توزيع مدربين أو ترتيب مع شريك أو أداة رقمية أو محتوى على الموقع الإلكتروني في أي وقت.

We may amend these Terms from time to time. The version in force at the time of purchase or use generally applies unless a change is required by law or expressly accepted by you.

ويجوز لنا تعديل هذه الشروط من وقت لآخر. وتسري عادةً النسخة المعمول بها وقت الشراء أو الاستخدام ما لم يكن التعديل مطلوباً بموجب القانون أو مقبولاً منك صراحةً.

23. Governing Law and Disputes

٢٣. القانون الواجب التطبيق والنزاعات

These Terms shall be governed by the applicable laws of the United Arab Emirates.

تخضع هذه الشروط للقوانين المعمول بها في دولة الإمارات العربية المتحدة.

The parties shall first seek to resolve disputes amicably and in good faith before escalating them formally.

يسعى الطرفان أولاً إلى حل النزاعات ودياً وبحسن نية قبل تصعيدها بشكل رسمي.
